Acceptance of Terms

By accessing or using CognisentAI's website, platform, or services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our Services.

These Terms apply to all visitors, users, and others who access or use our Services. If you are using the Services on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.

Our Services

CognisentAI provides AI-powered software solutions including, but not limited to:

• PropertyPilot: An AI platform for real estate portfolio management, automated valuations, and market analysis.
• AI Consulting: Strategic advisory services for AI integration and transformation.
• Custom AI Development: Bespoke AI model development and deployment services.

We reserve the right to modify, suspend, or discontinue any Service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

Accounts & Access

Account Creation

To access certain features, you must create an account. You agree to provide accurate, current, and complete information and to update this information as necessary. You are responsible for maintaining the confidentiality of your account credentials.

Account Security

• You are solely responsible for all activity that occurs under your account.
• You must immediately notify us of any unauthorised use of your account.
• We recommend enabling two-factor authentication.
• You may not share your account credentials with others.

Acceptable Use Policy

You agree not to use the Services to:

• Violate any applicable law, regulation, or third-party rights
• Transmit any harmful, offensive, or illegal content
• Attempt to gain unauthorised access to our systems or other users' accounts
• Use automated tools to scrape, crawl, or extract data without permission
• Reverse engineer, decompile, or disassemble any part of the Services
• Use the Services to develop competing products or services
• Transmit viruses, malware, or any other malicious code
• Interfere with the security or integrity of the Services

Violation of this policy may result in immediate termination of your account and legal action where appropriate.

Intellectual Property

The Services and their original content, features, and functionality are and will remain the exclusive property of CognisentAI and its licensors. Our trademarks, logos, and service marks may not be used without our prior written consent.

You retain ownership of any data you submit to the Services. By submitting data, you grant CognisentAI a limited licence to use that data solely to provide the Services to you.

Limitation of Liability

To the maximum extent permitted by law, CognisentAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Services.

Our total liability to you for any claims arising from these Terms or the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Services will cease immediately. You may request an export of your data within 30 days of termination.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the courts of Ontario, Canada.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or a prominent notice on our website. Continued use of the Services after changes take effect constitutes acceptance of the new Terms.
